▍雇主不能隨便調假?這些規則你一定要懂!

產業類的雇主說要把國定假日、休息日與工作日調移,這樣可以嗎?

可以,但必須經過勞工同意,不能單方面決定!

•國定假日:雇主可經勞資協商調移至其他工作日放假,但勞工必須同意

•休息日:須由勞資雙方協商,不能由雇主單方面變更

若調移假日卻仍要求出勤,雇主必須依法加發工資否則恐違反勞基法

•家事移工的休假依據勞動契約規定每 7 天應有 1 天休假

•若雇主要求家事移工於休假日工作則必須支付加班費

若相關權益受損,可向當地勞工行政機關反映,或撥打1955進行申訴!

Majikan di sektor industri mengemukakan ingin mengubah hari libur nasional, hari istirahat,dan hari kerja, apakah boleh seperti itu?

Boleh, tapi harus melalui persetujuan pekerja,tidak boleh diputuskan secara sepihak!

Jika hari libur dipindahkan tetapi pekerja tetap diminta untuk bekerja, maka sesuai peraturan yang ada majikan harus membayar upah tambahan. Jika tidak, bisa berarti melanggar Undang-Undang Ketenagakerjaan.

•Berdasarkan kontrak kerja, pekerja migran sektor rumah tangga berhakuntuk mendapatkan 1 hari libur setiap 7 hari

•Jika majikan meminta pekerja migran sektor rumah tangga untuk bekerja pada hari libur, maka majikan wajib memberikan upah lembur

Jika hak-hak tersebut dilanggar, Anda dapat melapor ke instansi ketenagakerjaan setempat atau menghubungi hotline 1955 untuk mengajukan pengaduan!

Nếu người lao động vẫn phải làm việc sau khi đã đổi ngày nghỉ, chủ thuê phải trả thêm tiền lương cho người lao động theo quy định của pháp luật,nếu không sẽ vi phạm Luật Tiêu chuẩn lao động.

•Giúp việc và khán hộ công gia đình được nghỉ 1 ngày trong 7 ngày làm việc theo hợp đồng lao động.

•Nếu chủ thuê yêu cầu người lao động làm việc vào ngày nghỉ thì phải trả lương làm thêm giờ.

Nếu quyền và lợi ích liên quan bị xâm phạm, bạn có thể phản ánh với cơ quan hành chính lao động địa phương hoặc gọi đến số 1955 để khiếu nại!

•การหยุดพักผ่อนของแรงงานต่างชาติในครัวเรือนจะเป็นไปตามกฎระเบียบที่ระบุในสัญญาจ้าง ทุก 7 วันต้องมีวันหยุด 1 วัน

•หากนายจ้างสั่งให้แรงงานต่างชาติในครัวเรือนทำงานในวันหยุดต้อง จ่ายค่าล่วงเวลา 

หากสิทธิประโยชน์ได้รับความเสียหาย สามารถแจ้งต่อหน่วยงานด้านแรงงานในท้องที่ หรือโทรร้องเรียนได้ที่สายด่วน1955 !
