移工在臺工作期滿續聘或轉換雇主時,仲介公司只能向續聘雇主或新雇主收取登記費與介紹費,總額不得超過移工第1個月薪資,對移工本人是不得收取任何費用的

仲介公司不得向移工收取仲介費或買工費

若違法收費最重可罰超收費用 20 倍並停業 1 年以下

提醒您

移工若遭要求支付續聘費或轉換費,應保留收費證據並立即向勞動部、地方政府或 1955 檢舉,經查屬實將依法嚴處,並可同意移工轉換雇主,移工不必擔心報案後影響工作

▍Labor brokerages are not allowed to charge foreign workers brokerage fees

When foreign workers in Taiwan seek to continue employment or change employers at the end of their contract, labor brokerages are permitted to charge the employer continuing the employment or new employer a registration fee and referral fee, the total amount of which cannot exceed the worker’s first-month salary. Foreign workers cannot be charged any fees

Labor brokerages cannot charge foreign workers brokerages fees or referral fees.

The illegal charging of fees can result in a fine 20 times the fee illegally charged and suspension of business operations for up to one year

Remember

If a foreign worker is asked to pay employment continuation or transfer fees, they should keep evidence of the fees and immediately file a report with the Ministry of Labor, local government, or call the 1955 Hotline. ▍Công ty môi giới không được thu phí môi giới của lao động nhập cư

Công ty môi giới không được thu phí môi giới hay phí mua việc làm từ lao động nhập cư

Nếu thu phí bất hợp pháp, nặng nhất sẽ bị phạt tiền gấp 20 lần số tiền thu vượt quá mức phí và đình chỉ hoạt động kinh doanh tối đa 1 năm

Xin nhắc nhở

Nếu người lao động nhập cư bị yêu cầu trả phí gia hạn hợp đồng làm việc hoặc phí chuyển đổi chủ, nên giữ lại bằng chứng về các khoản phí đó và lập tức tố giác ngay với Bộ Lao động, chính quyền địa phương hoặc 1955. Nếu các cáo buộc được xác minh đúng sự thật, vụ việc sẽ được xử lý nghiêm khắc theo pháp luật. Và người lao động nhập cư có thể được phép thay đổi chủ lao động, người lao động không cần phải lo lắng về việc tố giác sẽ ảnh hưởng đến công việc

▍ห้ามบริษัทจัดหางานเรียกเก็บค่านายหน้าจากแรงงานต่างชาติ

เมื่อแรงงานต่างชาติทำงานในไต้หวันครบกำหนดสัญญาและมีการต่อสัญญาหรือเปลี่ยนนายจ้าง บริษัทจัดหางานสามารถเรียกเก็บได้เฉพาะค่าลงทะเบียนและค่าบริการจัดหางานจากนายจ้างเดิมหรือนายจ้างใหม่เท่านั้น โดยยอดรวมต้องไม่เกินค่าจ้างเดือนแรกของแรงงานต่างชาติและห้ามเรียกเก็บค่าใช้จ่ายใดๆ จากแรงงานต่างชาติโดยเด็ดขาด

ห้ามบริษัทจัดหางานเรียกเก็บค่านายหน้าหรือค่าซื้อตำแหน่งงานจากแรงงานต่างชาติ หากฝ่าฝืนกฎหมาย 

จะถูกปรับสูงสุดถึง 20 เท่าของจำนวนเงินที่เรียกเก็บเกินและ

จะถูกสั่งพักกิจการไม่เกิน 1 ปี

คำเตือน

กรณีที่แรงงานต่างชาติถูกเรียกเก็บค่าต่อสัญญาหรือค่าเปลี่ยนนายจ้าง ควรเก็บหลักฐานการเรียกเก็บเงินไว้ และแจ้งหรือร้องเรียนต่อกระทรวงแรงงาน กองแรงงานท้องถิ่นหรือสายด่วน 1955 ทันที หากตรวจสอบแล้วพบว่าเป็นความจริง จะดำเนินการลงโทษตามกฎหมายอย่างเคร่งครัด และอนุญาตให้แรงงานต่างชาติสามารถเปลี่ยนนายจ้างได้ ทั้งนี้ แรงงานต่างชาติไม่ต้องกังวลว่าการร้องเรียนจะกระทบต่อการทำงาน

ปฏิเสธการเรียกเก็บเงินที่ไม่เป็นธรรม เพื่อคุ้มครองสิทธิประโยชน์ของตนเอง
